One of my friends introduced me this case: his kid wear the ortho-k for 6.5 years and now is suffering from the single eye double vision. they have visited many o.d. and m.d. and there is no solution. i believe that he and his attorney should win the case due to several strong reasons: 1. the od destroyed the original eye image (that is the base for the lens) for the active patients -- this may also lead the class lawsuit since he may destroy a lot of other patients' original eye images intentionally or technically; if there is no such original image, there is no evidence to show how the ortho-k lens changed the corneal shape and caused the irregular astigmatism and double vision. if this o.d. technically did this, he lost this case; if this o.d. intentionally did this, it is a more serious crime! 2. the o.d. misleads the patients: when the patients complained the dry-eye that caused by the ortho-k, he never told the patients stop wearing the ortho-k (even the signed agreement, there is no such warning). the o.d. asked patients to buy lubricants that sold by his clinic and asked the patients pay money to new lens. 3. the o.d. misleads the patients that the "vision is reversible" after discontinuing wearing the ortho-k in written and oral. now after one more year discontinued wearing the orhto-k, the patient still is suffering double vision (for each eye) and can't drive at night even wearing the normal glasses. so, it is fact that vision is not revere able! and more... this ortho-k lens made by c&e gp specialist; this product is reported to be approval by fda in 2004. but from fda web site, we can’t find the fda approval notice and related documentation (including specification of design). in 2005 fda warned the c&e gp specialist without complaint handling system. this o.d. started to sell this lens before fda approval. the patient told me that they requested the o.d. and the company for the fda approval notice and related documentation but failed so far. please email me laiyongjun63@yahoo.com for more details and thanks. the google search produced too much results. so, it should be very helpful if someone can provide a short list of these sucessful attonery who won the medical malpractice escpaiily in the optical/vision area. correction: "destroyed" seems to be incorrect at least now because this o.d. now said that it is hard to retrivable and he will talk the manufacture.
