Q. Can i get fired for taking a personal day? first of all, i'm not looking for any opninions. i'm looking for facts only. i needed to take a personal day on a day that both my manager and his boss will be out. the response was that my request was declined and i was told if i don't show up for work i'll get a warning and maybe get fired. can they do this? can they force me to work like this?
btw...the only reason i requested the day of is becuase i was told that working out of another office that is convenient to waht i need to do is not acceptable since i'm the senior guy in my group. reality is with multiple phones and e-mail...i don't need to be there.
back to the issue...can they legally even threaten to fire me for this? what should i do?

I'm not an attorney but this is what I know.
Depending on the state you live in - you are most likely an "at will" employee. This was something that was stated to you when you were hired. Look at your HR paperwork or your company's website to see if you have any information posted there.
What this means is they can let you go at any time for any reason with or without cause. Basically - they can lay you off, fire you, or suspend you if they want for any reason or no reason.
Now - if you are a protected class - over a certain age, usually 40, a female, pregnant, a minority or any combination they'd have a harder time doing it. If you had to take this time to go to the doctor and had a doctors note etc, they'd probably have a harder time firing you if you threatened to sue.
Is it worth the risk? That's up to you? Are you a woman, pregnant, a minority, a protected class etc? would or could you sue if you were fired? Probably not if you are an at will employee and they didn't discriminate against you.
Not exactly facts but that's what little I know about HR matters. I wouldn't risk it. HR said not to do it, I wouldn't.


Q. How do personal leave days work? i just got a full time job, and it included a few pl days for the year. i'm just out of school and have only worked part time jobs where requesting a day off is easy, so i don't really understand how pl days work.
do i have to use one when i want to request a day off in advance? or are they more for taking a scheduled work day off?
and are pl days paid?
do i have to use one if i end up calling in sick? i don't think i get sick leave days until i've been there for a year.

Can you tell me the policies or grounds for dismissal on a job for taking a personal day off? my husband took a personal day off yesterday from work to take a test for another job. now he has had this personal day off that he is entitled too with pay off, on the calandar at work for at least 3 weeks now. his boss got wind of what he was doing and called him in his office today to discuss this. his boss told him the reason why he is letting him go is because he did not tell him why he was taking a personal day off. his boss did not ask when he requested that day off, foremost he doesnt have to because this is his day that he is entitled too right??? his boss told him since he was looking for another job then maybe he should look for someone to replace him. there is no guarantee that he will get this other job, that's why they had to take a test for it. what are my husband's rights and is there any where on the internet to find out what his rights are. we live in georgia if that helps with anything. so please yahoo friends tell me what you think and what rights we have.

Your husband needs to contact the EEOC (Equal Employment Opportunity Council) you can go on line and type in a search engine. The EEOC helps against discrimination and injustices, like the one your husband is living. Oh! FYI: have him document all the meetings, events and conversations with his boss and HR. Always cover butt. Example of documentation that he can use.

I also suggest that he read over his companies policy manual and go directly to HR. He can also go directly to the Unemployment office and they can guide him too. An a personal day is exactly what it means. Your husband doesn't have to explain himself at all. Your husband has the right to search for a better job. I believe his boss is envious of your man. People like your husband boss really get me pissed off.

Can an employer request documented travel time to work? as a field inspector using a personal car and reimbursed for company mileage, does the employer have any precedent right to request and document what time the inspector leaves his house? any stops along the way prior to the start of the work day? whether reporting to the office or the field location?
It is your car. You are only required to turn in a mileage log. The rest of the info. is an invasion of privacy.


Q. If you are sick or injured and call out of work can the company force you to use a personal or vacation day? if you are sick or injured can the company "force" you to use one of your "personal" or "vacation" days to cover the missed time (hourly employee) when you request it to be "unpaid" time?
here is the exact scenario; i called out "sick" when i injured my knee and they "took" one of my personal days without my authorization to "compensate" for the 40 hour workweek, i am an "hourly" worker.
i have been unable to find an answer to this specific circumstance under the "family medical leave act" regulations but believe they are not allowed to "take" your personal or vacation time for up to 12 weeks of "unpaid" fmla time if you request it to be "unpaid" time off?
can anyone give me guidance on this to help straighten out our hr office here? thanks in advance!

Your HR office in handling this correctly.
FMLA is for job protection related to serious illness of you or a family member or birth/adoption of a child. It is never less than 3-days and requires doctor certification.
Missing ONE day for a knee problem is NOT eligible for FMLA job protection.
For both "time off" and FMLA, an employer can require the employee to use any time on the books (sick, vacation, personal, pto, etc) before any unpaid time is given. There are a several reasons for this:
1) time on the books is a liability towards the company (impacts profit)
2) the cost of the time increases whenever an employee gets a raise; obviously, it's better to pay out at the lower amount.
2) they don't want an employee to be off an extended period, return and then immediately want more time off.


Q. Can i request a copy of everything in my personal work file? it seems lately that my managers have gone off the deep end. for the past 2 weeks one of us has had a sit down meeting with the main boss/ owner at least once every 2-3 days. anyhow when she talked to me yesterday she said she wouldn't let anyone ruin her dad's dream and she'd start firing people and she had let someone go before she called me in. but while she was talking to me she said she would be putting all these factors into each one of our personal work files.
i guess what i'm wondering is, i've kinda gotten over the whole getting to work and it being a really nervous/ harsh work environment. the coworkers here are even frowned on and sort of interigated if we go out outside of work. i'd like a copy of my work profile so i know if i should be worried some or even use them as a reference (i've been here close to 3 years).

Legally your employer is not obligated to share your personnel file unless there is an issue of wrongful termination brought on.
That being said, most good employers will actively engage their employees and share feedback, ratings, raises, and career path information as part of a good working relationship.
It doesn't sound like you have that in your current employer so your next step is to develop a strategy that allows you to minimize any potential negative feedback from them.
Most smart companies have what is called a "neutral reference policy" which simply means that they will only verify that you have have worked for them, how long, and in what capacity (e.g. sales, accounting, etc.). That's it.
The reason is they don't want to open themselves up to possible slander (e.g. they really talked poorly about you) and other nasty entanglements that can happen. Your references should be from current & past business relationships that you have with people you can confide in and ask that they be a personal reference.
A former boss, co-worker or even teacher are always excellent references. Be sure to give them a courtesy call BEFORE you use them as a reference and tell them you'd like to use them as a reference and who/when to expect calls from.
A strong business network of former and current managers, co-workers, and educators are a valuable tool for your career. Make sure you stay in touch with folks -even if it's just an email to say hi- having these connections always bear dividends throughout your career.

ok so anyway here is what i need.
i need the memo to state that in the future any requests for employee time off such as personal days off, sick days, vacation, etc need to be reported to the office manager stacey and not to the receptionist or anyone else. my boss stated that things fall through the cracks and then there are conflicts with employee coverage so this will no longer occur if it is only reported to one person.

If you are in the US, you might be able to use the Family Medical Leave Act to get some time off. If your company has more than 50 employees and a doctor says that you need to take more than 3 days off for stress, gives you a prescription and you have a follow up visit, you may qualify. You cannot be disciplined for using FMLA leave and it can help you to get away long enough to cope with whatever is bothering you.
